Xtreme Desktops, a part of The Visionaire Groupc, Inc. has implemented the following set of privacy principles which describes how we collect, use and share personally identifiable information ("PII") and anonymous information we obtain from and about individuals located in the U.S.
Please note that none of our online activities are directed towards children under 13. We highly encourage parents to talk to their children about safe and responsible use of their PII.
From time to time Xtreme Desktops may revise this Privacy Policy to reflect changes in the law, technology, our PII collection and use practices, the features of our web sites or industry initiatives. Those revisions will be reflected in this Privacy Policy and the date of the last update will be noted at the beginning of the Policy. Therefore, you should review it periodically so that you are up to date on our most current policies and practices. If Xtreme Desktops materially changes its practices regarding collection or use of your PII, your PII will continue to be governed by the Policy under which it was collected unless you have been provided notice of and have not objected to the change.
1. COLLECTION - COLLECTION OF PERSONALLY IDENTIFIABLE INFORMATION ("PII") ") AND OTHER TYPES OF INFORMATION BY XTREME DESKTOPS:
PII: The only time that Xtreme Desktops collects PII is on www.xtremedesktops.com when the user voluntarily registers to receive our newsletter. The only PII that Xtreme Desktops collects are email address and name. When we collect your email and name we do so because you are voluntarily submitting the information to us in order to receive our newsletter or other email correspondence from Xtreme Desktops. Your name is used only to personalize the email correspondence.
Anonymous Data: Xtreme Desktops uses session ID's which do not get stored on your computer, but simply relay anonymous information regarding the use of our applications such as promotional views, clicks and install and uninstall data to the Xtreme Desktop database. Xtreme Desktops associates this information with a randomly generated user ID that can not be tied to your personal information in any way. This data is stored in a database and only Xtreme Desktops and our client for the specific desktop application have access to it. Our Client's may share this anonymous information with their agencies or others working on their behalf. This data is stored in order to allow us and our clients to optimize the applications to create a better user experience for you.
2. NOTICE - XTREME DESKTOPS WILL PROVIDE YOU WITH NOTICE ABOUT ITS PII COLLECTION PRACTICES:
When you voluntarily provide PII to Xtreme Desktops through www.xtremedesktops.com, we will make sure you are informed about who is collecting the information, how and why the information is being collected and the types of use Xtreme Desktops will make of the information.
Xtreme Desktops' applications are commissioned by third-party companies and the collection of any PII through the desktop application will pass directly through to the third-party and will not be connected with any anonymous user behavior information tracked on the Xtreme Desktop servers through session ID's. Xtreme Desktops does not collect any PII from our desktop applications. Thus, it is highly recommended that you check the applicable privacy policy of the third-party which will be found at their official website. Xtreme Desktops is not responsible for the privacy practices of third-parties.
3. CHOICE - XTREME DESKTOPS WILL PROVIDE YOU WITH CHOICES ABOUT THE USE OF YOUR PII:
If at any time you would like to be removed from the Xtreme Desktops Email database you can send an email to info@xtremedesktops.com with the subject line REMOVE ME. Your email and name will be removed from the list within 48 hours. We do not collect any additional PII through our site or desktop applications.
There may be times when a third-party who has commissioned us to build an Xtreme Desktop for them asks you to submit PII through the Xtreme Desktop. In those instances Xtreme Desktops does not collect that information and does not have access to it. It goes directly to the third-parties database system. You should consult the website for the company who commissioned the Xtreme Desktop application and refer to their privacy policy to determine if you would like to submit your information and what choices you have to control that information once submitted. 4. USE - XTREMEDESKTOPS USE OF PII:
Xtreme Desktops will use your PII provided under this Policy in a manner that is consistent with this Policy. Xtreme Desktops will not provide or share your email address to a third party at any time without your permission. However, we may send newsletters or other email correspondence that provides you with download links to Xtreme Desktop applications that were commissioned by third parties.
Should Xtreme Desktops be bought or sold the privacy principles described in this email will remain intact. Xtreme Desktops may contact you and provide the opportunity to opt-in to receive additional services. If you do not opt-in to these additional services your information will remain under the terms of this Privacy Policy.
If Xtreme Desktops goes bankrupt or shuts down and goes out of business your personal information will be destroyed.
5. SECURITY - XTREMEDESKTOPS PROTECTS THE SECURITY OF PII:
Xtreme Desktops uses reasonable administrative, technical, personnel and physical measures to safeguard your information in its possession against loss, theft and unauthorized use, disclosure or modification.
6. ACCESS - HOW TO ACCESS, CORRECT OR DELETE YOUR PII:
Email info@xtremedesktops.com with the subject header of REMOVE ME if you would like you email to be removed from our database. If you have provided any PII to a third-party through an Xtreme Desktops application please refer to their privacy policy to determine how to access your information.

Please read these terms of use carefully before downloading and using the Xtreme Desktop. If you do not agree with any of the Terms of Use, do not install the Xtreme Desktop and delete all installation files from your computer that may have been downloaded already. Participant's continued use of the Xtreme Desktop after a change has been to the Xtreme Desktops, LLC policies implies Participant's assent to those changes. An online version of the Xtreme Desktops, LLC Terms and Conditions can always be found online at http://www.xtremedesktops.com.

ALL MATERIALS CONTAINED IN ALL XTREME DESKTOPS, INCLUDING, BUT NOT LIMITED TO, IMAGES, ILLUSTRATIONS, AUDIO CLIPS, AND VIDEO CLIPS INCLUDING BUT NOT LIMITED TO TRAILERS, TV SPOTS AND ANY AND ALL AUDIO VISUAL MATERIALS (COLLECTIVELY “THE MATERIAL”) ARE PROTECTED BY COPYRIGHT AND TRADEMARK AND SHALL NOT BE USED FOR ANY PURPOSE WHATSOEVER OTHER THAN PRIVATE, NON-COMMERCIAL VIEWING PURPOSES. TRANSFERRING OF DOWNLOADABLE MATERIAL:
Xtreme Desktops, LLC and its affiliated partners grant Participant a non-exclusive, non-assignable, and non-transferable license to use and display the Xtreme Desktop, for personal and noncommercial use only, including, but not limited to, any files, codes, audio, or images incorporated in or generated by the software (collectively “Downloaded Material”) provided, however, that Participant must maintain all copyright and other notices contained in such Downloaded Material. Participant acknowledges and agrees not to sublicense, assign, or otherwise transfer this license or the Downloaded Material for any commercial purposes. Participant can share downloaded files with others only if the Downloaded Material is not altered and all copyright and legal notices are maintained. Participant also agrees not to alter, disassemble, decompile, reverse engineer, or otherwise modify the Downloaded Material.
PARTICIPANT'S INDEMNIFICATION / OBLIGATIONS:
Participant agrees to defend, indemnify and hold harmless Xtreme Desktop, LLC, all subsidiary and affiliated companies and their respective directors, officers, employees and agents from and against all claims, losses, costs and expenses (including attorneys fees) arising out of Participant's use of an Xtreme Desktop, or arising out of any violation of the Terms and Conditions of Use by Participant including, without limitation, any communication by Participant which is claimed to be defamatory, obscene or otherwise unlawful, which is claimed to violate the copyright, trademark, proprietary or other rights of third parties, or which constitutes a submission of materials.
TERMINATION:
Xtreme Desktops, LLC and affiliated partner companies shall have the right to immediately terminate any Participant's use of an Xtreme Desktop if either Xtreme Desktops, LLC or their affiliated partners determine in their sole discretion that Participant has violated the Terms and Conditions of Use set forth herein or otherwise breached this agreement, or has engaged in conduct which either Xtreme Desktops, LLC or their affiliated companies determine in their sole discretion to be unacceptable.
MISCELLANEOUS:
This Agreement constitutes the entire agreement of the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous written or oral agreements between the parties with respect to the subject matter hereof. This Agreement shall be construed in accordance with the laws of the State of California, and parties consent to the jurisdiction of the courts in the Central District of California, County of Los Angeles, without regard to its conflict of laws rules.
Xtreme Desktops contain neither expressed nor implied warranties for use. Xtreme Desktops, LLC does not warrant that all Xtreme Desktops will be without viruses or defects, and Xtreme Desktops, LLC is not responsible for any repair or maintenance visitor's system may require as a result of using an Xtreme Desktop.
Xtreme Desktops LLC is operated from Los Angeles, California. Participants attempting to download an Xtreme Desktop from other locations do so of their own volition and shall comply with any applicable local laws governing interactive sites.
